Landmark Ruling in 40-Year Property Dispute at Nakifuma Court

Nakifuma Magistrate’s Court dismissed Sarah Nantongo’s claim to a house built by her ex-husband, Moses Kawunawwo Ddungu, in a 40-year property dispute.

Nakifuma Magistrate's Court has delivered a decisive verdict in a protracted 40-year property dispute between former spouses, with Chief Magistrate Peter Gukina dismissing Sarah Nantongo's claims to a house constructed by her ex-husband, Moses Kawunawwo Ddungu, in Ntunda Sub-County, Mukono District.  

 
The court heard how Nantongo sought to reclaim rights to the disputed property after their separation, alleging abandonment during her overseas work. However, Magistrate Gukina ruled her claims lacked legal basis, noting: "The plaintiff failed to substantiate her ownership claims with credible evidence."  

 
Kawunawwo detailed his 20-year marriage, including Nantongo’s relocation, remarriage, and disagreements over their children’s baptism.
 
The court noted this was Nantongo's 17th lawsuit against her ex-husband, including previous unsuccessful defamation and assault claims. Kawunawwo expressed relief: "I thank God the truth has finally prevailed in this matter."  

 
Florence Musimenta, Kawunawwo's current wife, testified about financing the disputed property's construction through their joint business ventures. Meanwhile, one of Nantongo's children present in court appeared devastated by the ruling's implications for their inheritance claims.  
 
Magistrate Gukina advised Nantongo to pursue any appeals in higher courts while emphasising proper legal procedures. The ruling sets a precedent for similar marital property disputes in Uganda's judicial system.
